Copyright Infringement Notification

DiscordGalaxy respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to claims of copyright infringement on our platform.

Filing a DMCA Notice

If you believe that content on DiscordGalaxy infringes your copyright, please provide our designated Copyright Agent with the following information:

1. Identification of Copyrighted Work

A description of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.

2. Identification of Infringing Material

A description of where the infringing material is located on our platform, with sufficient detail to allow us to locate it. Please provide:

  • Direct URL or link to the content
  • Server name and description
  • Screenshots if applicable
  • Any other identifying information

3. Contact Information

Your contact information, including:

  • Full legal name
  • Mailing address
  • Telephone number
  • Email address

4. Good Faith Statement

A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

5. Accuracy Statement

A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

6. Physical or Electronic Signature

Your physical or electronic signature (typing your full legal name is acceptable).

How to Submit a DMCA Notice

Important: Please ensure your notice includes all required elements listed above. Incomplete notices may not be processed.

Our Response Process

Upon receiving a valid DMCA notice, we will:

  1. Review the Notice: Verify that all required information is included
  2. Remove or Disable Access: Promptly remove or disable access to the allegedly infringing material
  3. Notify the User: Inform the user who posted the content about the removal
  4. Document the Claim: Maintain records of the notice and our response
  5. Repeat Infringer Policy: Terminate accounts of users who repeatedly infringe copyrights

Counter-Notification

If you believe that content you posted was removed in error or misidentification, you may file a counter-notification with the following information:

Required Information

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located
  • A statement that you will accept service of process from the person who filed the original DMCA notice

Send counter-notifications to the same Copyright Agent contact information listed above, with the subject line: "DMCA Counter-Notification"

Counter-Notification Process

After receiving a valid counter-notification:

  1. We will forward the counter-notification to the original complainant
  2. The complainant has 10-14 business days to file a court action
  3. If no action is filed, we may restore the removed content
  4. If legal action is filed, we will await the court's decision

Repeat Infringer Policy

DiscordGalaxy has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and terminate the accounts of any users who infringe any intellectual property rights of others.

False Claims

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be subject to liability. Please ensure your claim is accurate and made in good faith.

Limitations

Please note:

  • We are not responsible for determining whether content infringes copyright
  • We act as an intermediary and remove content based on valid DMCA notices
  • We do not provide legal advice regarding copyright matters
  • Processing times may vary depending on the complexity of the claim
  • We reserve the right to refuse to process incomplete or invalid notices
